These Terms and Conditions (“Terms”) govern your access to and use of the website www.risecorp.com (the “Site”), owned and operated by RISE INC. (“RISE”, “we”, “us”, “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

These Terms apply to all users of the Site, including visitors, partners and customers. We may update these Terms from time to time. When we do, we will change the “Last Updated” date above, and for material changes we will provide a more prominent notice on the Site. Changes apply from the date they are posted, and your continued use of the Site after that date means you accept the updated Terms.

2. Definitions

  • “Services” means the information, content, chat assistant and other functionality offered through the Site. Our industrial software solutions, digital transformation tools and related support are provided under separate written agreements.
  • “User” or “you” means anyone visiting or using the Site.

3. Acceptable Use

You agree that you will:

  • Use the Site only for lawful purposes and in compliance with all applicable laws.
  • Not post, transmit or share any harmful, offensive, infringing or illegal content.
  • Not attempt to gain unauthorized access to the Site, our servers, accounts or networks, or to probe, scan or test their vulnerability, except as described in Section 4.
  • Not introduce viruses, malware or other harmful code, or interfere with the Site’s operation (for example, through denial-of-service attacks).
  • Not use bots, scrapers or other automated means to collect content or data from the Site without our written permission.
  • Not impersonate any person or misrepresent your affiliation with any person or organization.

Unauthorized use of the Site may result in termination of access and possible legal action.

4. Security and Responsible Disclosure

We take the security of our Site seriously. If you believe you have found a security vulnerability, please report it to customerservice@risecorp.com with the subject “Security Report”, and give us reasonable time to fix it before disclosing it publicly. Please do not access, change or delete data that does not belong to you, disrupt our services, or use social engineering while investigating. We will not pursue legal action against good-faith reports that follow these guidelines.

5. Intellectual Property

All content on the Site, including text, graphics, logos, product descriptions, designs and software, is the property of RISE INC. or its licensors and is protected by copyright, trademark and other intellectual property laws. You may view and print pages for your own non-commercial reference. Otherwise, you may not:

  • Copy, reproduce, republish, upload, post, transmit or distribute any material from the Site without our written consent.
  • Use any of our trademarks, logos, names or other proprietary identifiers without permission.

6. Use of the Site and Services

The Site provides information about our digital transformation tools and solutions, industry platforms and support. You understand that:

  • The Site and its content may be updated, modified or discontinued at any time.
  • Our products and services are subject to separate agreements, licenses or fees, which prevail over these Terms for those products and services.
  • We do not guarantee continuous, uninterrupted, secure or error-free access to the Site.

7. Chat Assistant and AI-Generated Content

The Site includes an automated chat assistant that uses artificial intelligence (AI) to generate replies. By using it, you understand and agree that:

  • Replies are generated automatically and may be inaccurate, incomplete or out of date. They are provided for general information only and are not professional, technical, legal or contractual advice, quotes or commitments. Please confirm important information with our team.
  • Your conversations are recorded, stored and processed as described in our Privacy Policy.
  • You must not enter sensitive personal information, passwords, confidential business information or third-party personal data into the chat.
  • You must not use the chat assistant to generate unlawful content, or attempt to manipulate, overload or extract its underlying instructions or data.

8. Content You Submit

If you submit content to the Site (for example, through forms, chat or feedback), you grant RISE INC. a worldwide, royalty-free license to use, reproduce and process that content for the purpose for which you submitted it and to improve our Site and Services. You confirm that you have the right to submit the content and that it does not violate anyone else’s rights. Any personal information in your submissions is handled according to our Privacy Policy.

9. Third-Party Links and Content

The Site may include links to, or embedded content from, third-party websites and services (such as videos, documents and social media) that we do not own or control. We are not responsible for their content, privacy practices or terms. Your use of third-party sites and content is at your own risk and subject to their terms.

10. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, RISE INC. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, RISE INC. and its officers, directors, employees, agents, partners and licensors will not be liable for any indirect, incidental, consequential, special or punitive damages arising from your use of, or inability to use, the Site, including loss of profits, loss of data, damage to systems, or any other losses related to your access to or use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless RISE INC. and its officers, directors, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

13. Privacy

Our Privacy Policy explains how we collect, use, share and protect personal information, including your rights under the GDPR, U.S. state privacy laws and India’s DPDP Act, and how to exercise them. Your choices about cookies and tracking technologies are managed separately through our Cookie Settings, and you can opt out of the sale or sharing of personal information using the Do Not Sell or Share My Personal Information link.

14. Age Requirement

The Site is intended for business users and is not directed to children. You must be at least 18 years old, or the age of majority where you live, to use the Site and its Services. We do not knowingly collect personal information from children, as explained in our Privacy Policy.

15. Termination

We may suspend or terminate your access to the Site at any time, without prior notice, if you breach these Terms or if we reasonably believe your use creates risk or legal exposure for us or others.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas, except where the laws of your country of residence give you the right to bring proceedings in your local courts.

17. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Site, form the entire agreement between you and RISE INC. regarding your use of the Site. Separate written agreements for our products and services prevail for those products and services.
